Terms & Conditions

1. Introduction

Welcome to Melby's Landscaping. These Terms and Conditions ("Agreement") govern your use of our services in California and outline mutual rights and responsibilities. By engaging with us, you agree to comply with these terms.

2. Services

We provide the services described in individual contracts or service agreements. All work will be done with reasonable skill and care per applicable standards in California.

3. Quotations and Payment

  • All price estimates are based on current scope and may change if the scope of work changes.

  • Accepted payment methods include cash, check, and electronic transfers.

  • California law requires clear disclosure of payment terms and handling of deposits.
     

4. Cancellation and Refund Policy

  • Deposits are refundable if cancellation is made more than 72 hours before scheduled work.

  • Deposit forfeiture may apply for cancellations within 72 hours due to preparatory costs.

  • Refunds will be considered if services are not delivered as contracted or due to workmanship errors attributable to us.

  • California’s consumer protection laws may require additional refund rights; any such rights supersede this policy.
     

5. Client Responsibilities

Clients shall provide reasonable access to the work site and maintain the property in a condition that allows safe and efficient work. Additional costs or delays caused by client actions or site conditions outside our control may incur extra charges.
 

6. Limitation of Liability

  • Our liability for damages arising out of services provided shall be limited to the amount paid by the client for the specific service.

  • We are not responsible for damages caused by factors beyond our control, including weather, natural events, or external conditions.

  • California law limits disclaimers of certain liabilities, so this limitation is subject to applicable legal scope.
     

7. Intellectual Property

All designs, plans, or creative works produced by Melby's Landscaping remain the company’s property unless otherwise agreed in writing.
 

8. Termination

Either party may terminate the agreement upon written notice if there is a material breach. Payments for completed work remain due.
 

9. Dispute Resolution

We encourage direct communication for dispute resolution. If unresolved, disputes are subject to mediation before any legal actions.

  • In California, binding arbitration clauses are common; you may consider adding one for faster resolution if desired.
     

10. Governing Law

This Agreement is governed by the laws of the State of California. California-specific laws, including those related to contracts, consumer rights, and business practices, apply to all transactions under this Agreement.
 

11. Changes to Terms

We reserve the right to update these Terms and Conditions as necessary. Clients will be notified of significant changes. Continued use of services constitutes acceptance of the revised terms.
